You need to consider the Sale of Goods Act 1979:

http://www.e-lawresources.co.uk/Statutory-implied-terms.php

and also express terms and representations:

http://www.e-lawresources.co.uk/Contents-of-a-contract.php

In relation to the exclusion clause you first need to consider the common law position. Ie has the clause been incoporated into the contract and does it cover the loss which has occured:

http://www.e-lawresources.co.uk/Unfair-terms---regulation-by-common-law.php

In particular these cases may be useful:

http://e-lawresources.co.uk/forum/viewtopic.php?f=38&t=201

http://e-lawresources.co.uk/forum/viewtopic.php?f=38&t=209

You then need to consider the Unfair Contract Terms Act 1977:

For a). You need to consider breach of contract and whether the term is a condition or warranty or an innominate term:

http://www.e-lawresources.co.uk/Contents-of-a-contract.php

For b). you need to look at offer and acceptance:

http://www.e-lawresources.co.uk/Offer-and-acceptance.php

and the effects of a counter offer in Hyde v Wrench:

http://www.e-lawresources.co.uk/forum/viewtopic.php?f=32&t=58

For c). you need to look at the distinction between an offer and an invitation to treat with regard to advertisements.

http://www.e-lawresources.co.uk/Offer-and-acceptance.php

In particular Carlill v Carbolic smoke ball

http://www.e-lawresources.co.uk/forum/viewtopic.php?f=32&t=45

and Partridge v Crittenden:

http://www.e-lawresources.co.uk/forum/viewtopic.php?f=32&t=67

:)i Dont despair it sshould be easy to get notes on the summer exams. As Stat and Dele came up in Jan make sure you can do Precedent and legislation, Europe is boring but its either the institutions or the types of EU law.

For ELS make sure you can do at least seven topics, Police powers, sentencing are good, mode of trial, bail or appeal routes, look and see what came up before, ADR or High Court and County Court Track system, Magistrates or a lay people question, solicitors. Thats seven topics and you only need to answer 4 questions. Good luck

Hey everybody 8-)

I was just doing my Law coursework (G.C.S.E.) and I completely forgot what is meant by "Frayed Elastic". It's to do with Provocation and is really important because I have to put it in my description about provocation, otherwise I will get a bad grade which I really don't want. So if anybody could answer me A.S.A.P. because I really need to know. I've looked everywhere and all they do is give examples of it. I need a definition please so I have a idea of what to write about when I explain it in my description.

;D Thank You !
